What is happening
In January 2022, the 9th Circuit Court of Appeals ruled in favor of solar owners and against the monopoly utility Salt River Project (SRP). The court determined that SRP violated antitrust law by raising rates on solar customers.
The court relied on an Arizona law that says utilities like SRP should set their rates competitively. The court interpreted rooftop solar as part of that competition.
Arizona utilities want to eliminate this law and the competition with HB 2101 and SB 1631. These bills rewrite state law in favor of the utilities. They erase laws that protect your choice to install rooftop solar.
The bills are currently being heard in the Arizona Legislature. On February 14, HB 2101 failed in a House vote but could come back up for reconsideration.
